Beta Tester Addendum

These terms apply only while you’re using a beta build of WhisperBee.

Beta builds are distributed through Apple TestFlight or Google Play Internal Testing to invited testers only. Public App Store / Google Play installs are governed solely by our main Terms of Service.

1. Who this applies to

These Beta Tester terms (“Beta Terms”) apply to you if you received a personal invitation from WhisperBee to test the WhisperBee mobile app via Apple TestFlight (iOS) or Google Play Internal Testing (Android), accepted that invitation, and installed the resulting beta build.

By installing or using a WhisperBee beta build, you accept these Beta Terms in addition to the main Terms of Service and Privacy Policy. If you do not agree, do not install the beta build.

2. Beta status — what to expect

A beta build is unfinished software. Specifically, you should expect:

  • Bugs, crashes, layout glitches, and partially-implemented features
  • Behavior changes between builds (we may ship new versions every few days)
  • Server-side changes that affect AI output, suggestions, and rule firing without prior notice
  • Occasional sign-out or forced re-consent prompts when we update the legal version after counsel review
  • Sentry-collected error reports tied to your account, so we can debug regressions (no voice or inspection content is collected — see Privacy Policy §2.5)
  • Quotas and rate limits that may be tighter (or looser) than the eventual production limits

3. AS-IS, no warranties

The WhisperBee beta build is provided AS IS and AS AVAILABLE, with all faults, and without warranty of any kind. WhisperBee disclaims, to the maximum extent permitted by law, all warranties — express, implied, or statutory — including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, quiet enjoyment, and any warranty arising from course of dealing or usage.

The limitation of liability and indemnification provisions in the main Terms of Service §§ 12 and 13 apply with full force during beta. The AI Disclaimer at /legal/ai-disclaimer applies in full.

4. Beta data handling

Data you create during the beta — apiaries, hives, inspections, voice recordings, photos, treatments, harvests — is stored on the same production infrastructure that will serve the GA release, and we intend to preserve it through the transition to general availability.

However, beta-specific risks apply:

  • Data resets are possible. If we discover a serious data-integrity bug during beta, we may need to wipe and recreate test data, including yours, to fix it. We’ll give as much notice as the situation allows but we cannot guarantee notice in advance of an emergency reset.
  • Schema changes can affect prior records. Database migrations shipped during beta may change how older inspections render, even after the fact. We try to write forward-compatible migrations but cannot warrant zero regression.
  • Voice audio retention is the same as production. See Privacy Policy §7. Deleting individual recordings or your whole account works the same way it will in GA.

Your data-export and account-deletion rights from the main Privacy Policy and TOS apply during beta. Use the web portal at whisperbee.app/portal/account.

5. Feedback license

If you send WhisperBee feedback during the beta — bug reports, screenshots, AI miss reports, feature requests, design critiques, or any other suggestions or materials — you grant WhisperBee a worldwide, royalty-free, non-exclusive, perpetual, irrevocable, sublicensable license to use, reproduce, modify, and incorporate that feedback into the Service, future versions, marketing materials, or anywhere else we choose, without obligation of attribution, compensation, or confidentiality.

You represent that the feedback is yours to license, and does not contain confidential or proprietary information of a third party that we don’t already have rights to.

This mirrors the broader Feedback license at Terms of Service §10 and adds nothing new other than restating it for the beta context.

6. Confidentiality of unreleased features

The beta build may contain features, screens, prompts, AI behavior, or pricing information that has not yet been publicly announced. Please do not:

  • Post screenshots or screen recordings of unreleased features to public social media, blogs, beekeeping forums, or video platforms
  • Share the TestFlight invite link, the Play Internal Testing opt-in URL, or the build files themselves with anyone outside the invited tester list
  • Reverse-engineer, decompile, or attempt to extract the AI prompts, server endpoints, or proprietary configuration from the beta build

You are welcome to discuss your overall experience with friends and fellow beekeepers — “I’m beta-testing a hands-free beekeeping app” is fine. Posting a video of an unreleased AI chat surface is not.

Once a feature is publicly launched, this confidentiality restriction stops applying to it.

7. No resale, no production beekeeping reliance

The beta build is licensed for your personal evaluation only. You may not:

  • Use the beta build as the sole record-of-truth for a commercial beekeeping operation. Maintain parallel records (paper, spreadsheet, or another app) until WhisperBee reaches general availability.
  • Submit beta-generated reports as evidence to USDA ELAP, state apiary programs, or insurance claims. The export format may change before GA.
  • Resell, sublicense, rent, or otherwise commercially distribute the beta build.
  • Use the beta build to provide services to third parties (e.g., as an embedded tool inside a beekeeping consultancy you operate).

8. Beta is free; no in-app purchases

During beta, all WhisperBee features are made available at no charge. Hive caps, AI quotas, or other tier-based limits may apply but are typically relaxed for beta testers.

There are no in-app purchases on iOS or Android during beta or at GA. If you later choose to subscribe, you’ll do so at whisperbee.app/portal/billing via Stripe — see Terms of Service §4.

9. Termination of beta access

WhisperBee may revoke your beta access at any time, with or without notice, for any reason — including (but not limited to) breach of these Beta Terms, breach of the main Terms of Service, prolonged inactivity, or simply because we’ve closed the beta program. If your access is revoked, you must stop using the beta build and delete it from your devices.

You may leave the beta at any time by uninstalling the app or removing yourself from the TestFlight / Play Internal Testing tester list. Account data created during beta is retained per the main Privacy Policy and is deletable through Settings.

10. End of beta and transition to GA

When WhisperBee transitions to general availability:

  • These Beta Terms cease to apply. Your continued use is governed only by the then-current Terms of Service and Privacy Policy.
  • Your beta-build install will be replaced by the public App Store / Google Play install. Your account, hive data, and inspection history carry over automatically — you’ll just need to re-install from the public store.
  • We may offer a thank-you discount or trial extension as recognition for beta participation. Any such offer will be communicated by email.

11. Conflict with main Terms

These Beta Terms supplement, and do not replace, the main Terms of Service. If a provision in these Beta Terms conflicts with the main TOS, the Beta Terms control for the duration of your beta participation, but only to the extent of the conflict. All other TOS provisions — including dispute resolution, governing law, indemnification, and limitation of liability — apply unchanged.
